Software informático es el lenguaje de la era de la información. La capacidad de producir, modificar, adaptar y distribuir software condiciona la capacidad de cualquier comunidad o grupo, grande o pequeño, para interactuar con el mundo de computadoras y redes que constituyen la estructura (y no solo la infraestructura) de nuestra sociedad.. El control tecnológico privado del software es equivalente a la apropiación privada del alfabeto en los orígenes de la historia (y de hecho, lo apropiaron los escribas y sacerdotes que, según descubrimientos arqueológicos recientes realizados por los Marines en Irak, ya disponían de una licencia de Microsoft).
Obviamente, el acceso al código fuente condiciona la capacidad tanto de adaptación a usos, como, sobre todo, a la mejora continuada del software, o sea, en ultimo termino, a la innovación y al proceso recurrente de innovación.
Sabemos que, así como Internet, se desarrollo en libertad, el mundo del software evoluciono, por un lado, mediante lineas propias e incompatibles de cada sector de usuarios; por otro lado, mediante el monopolio creciente de Microsoft, con consecuencias decisivas, tanto en la apropiación de rentas monopolistas y encarecimiento de sus productos, como en la pobreza tecnológica, derivados de la eliminación sistemática de competidores.
Sabemos también del cambio de tendencia a partir de las derivaciones de UNIX, tanto en MIT, a través del AI Lab y los heroicos esfuerzos de Stallman y su lanzamiento de GNU y la licencia GPL, como de la historia de BSD a través de la tempestuosa relación entre Berkeley y Bell Labs. Y conocemos la extraordinaria saga de Linux, desde que Linus Torvalds decidiera, en 1991, para desarrollar el kernel del código fuente del sistema operativo que necesitaba para utilizar UNIX en su PC 386, acudir a la red cooperativa de voluntarios trabajando sobre el código fuente en sistema de código abierto. Sabemos hoy que Linux es un sistema operativo mas robusto que Windows y con mucha mayor capacidad evolutiva. Como sabemos que Apache, programa de software de servidor, también producido en código abierto por una comunidad libre de voluntarios autogestionada mediante una constitución propia, opera mas de dos tercios de los servidores de la worldwideweb. Y es conocimiento publico la existencia creciente de programas de software, en todos los ámbitos, que han sido producidos libremente, sin derecho de propiedad intelectual, sin trabajo pagado y sin estructura de poder impuesta. Hoy día, el reconocido éxito de Linux ha llevado a grandes corporaciones como Ibm y Oracle, así como a numerosos gobiernos en todo el mundo a utilizar Linux y otros programas de código abierto. Y a producir formas simplificadas del mismo para usos sociales, como el caso de Linex en Extremadura. Y, sobre todo, a adoptar el sistema cooperativo de libre asociación de productores y usuarios en el proceso de innovación tecnológica. Todo ello, sin que necesariamente se pierda el carácter capitalista de estas empresas o los objetivos propios de cada gobierno (el gobierno chino puede favorecer a Linux y al mismo tiempo censurar Internet). No se trata de oponer el mundo anarquista del código abierto al mundo capitalista de Microsoft. Aunque dudo que haya muchos anarquistas en Microsoft (salvo disecados en la oficina de Bill Gates) hay muchos capitalistas en el mundo del código abierto. Pero no todos los capitalistas son iguales o incluso no todos los capitalismos son iguales: los hay que, además de supeditar la sociedad al mercado, mas que capitalistas son rentistas, es decir bloquean la innovación. Y los hay que entienden que todo el mundo, incluso ellos, ganan mas, si hay mas innovación tecnológica y, en ultimo termino, mas reparto de la riqueza.
En suma, la historia del software libre, y mas ampliamente, la del movimiento de código abierto, demuestra que puede haber mas innovación tecnológica y mas productividad económica en un contexto de trabajo cooperativo y motivado, característico del mundo de la creación. Y esto es aun mas asi si a la productividad económica añadimos la utilidad social, que requiere una interacción estrecha entre los innovadores tecnológicos y los usuarios de la tecnología. Se plantea pues en muchos medios la ampliación del método cooperativo de creación característico del código abierto, a otros ámbitos de la producción y la gestión de la sociedad, desde las empresas autogestionadas a los servicios públicos hechos mas eficaces mediante el feedback continuo entre proveedores de servicios y usuarios, por ejemplo en la educación o en la salud.
Ahora bien, entre la promesa de la innovación cooperativa y la capacidad de la sociedad para disfrutar del fruto de dicha cooperación, se alza una concepción rentista y autista del derecho de propiedad intelectual.
